411 Games Fact or Fiction 07.05.11: Supreme Court, Call of Duty XP, Hotz and More

Welcome back to another week of 411 Games Fact or Fiction. I'm Adam Larck, and I finished up Red Faction Armageddon. Other than that, I'm trying to finish up a bit of my backlog before finally getting Dungeon Siege 3.

This week, we have Todd Vote and Jimmy Chavez going head-to-head. Let's see how these two do. Time for banner!





1.) It's great for gamers that the Supreme Court struck down the game-banning law.

Jimmy Chavez - Fact: There is already a system in place called the ESRB, which makes parents responsible for what games their children are able to get a hold of. That's more than enough. Anything else and you're just going too far with the whole control/censoring thing.

Todd Vote - Fact: I mean, what were they going to do after banning violent games? Go the book burning route? Oh, you know what we should also bring back Salem style witch hunts. The rating system is really all that is needed to monitor violent content in games. That is, assuming more stores, and parents follow the guidelines set by the ratings.

Score: 1 for 1 - This was a great decision by the Court to help support the First Amendment in a way that books, movies, TV and more already are.



2.) It's a bad move by Nintendo not to localize three Wii games quite a few owners are interested in.

Jimmy Chavez - Fact: Whatever happened to the Supply and Demand concept? If people want it, get it to them. Not really all that hard to understand now is it? If they can't get it through Nintendo, they'll find other ways to obtain it.

Todd Vote - Fiction: Well in a sense, I can't really blame Nintendo. If these games aren't in the plans, they should wait. They are obviously focused on development of the Wii U, so I think they can probably bring these games over at any time, and if these are such hardcore games, perhaps they are just waiting to bring them over on the WII U.

Score: 1 for 2 - This isn't the first time Nintendo has done it, and it won't be the last. I'm still waiting on Mother 3 to make it over here.



3.) George Hotz shouldn't be rewarded with a job at Facebook for hacking the PS3.

Jimmy Chavez - Fact: Should he be rewarded? No, he shouldn't. However, if I were Sony, I would retain his services and try to learn everything that he knows about the PS3 system. It's like in Las Vegas, when someone is caught cheating, they try to find out exactly how they did it to prevent it from happening in the future. That or they just kill'em.

Todd Vote - Fact: No hacker asshole should ever be rewarded for what they do.

Score: 2 for 3 - Rewarding people like this with good jobs is just asking for more trouble from other hackers.

4.) Call of Duty XP 2011 won't be as well attended as other events, such as BlizzCon.

Todd Vote - Fiction: Have you seen how rabid Call of Duty's fan base is? I mean sure some of them have weaned off and started claiming 'same old shit', but there is still an incredibly large amount of fans of the game. I think it will be a highly successful venture.

Jimmy Chavez - Fact: It will have its fair share of people, no doubt, but I don't think it will be as big as some of the others out there. Frankly, the Call of Duty series is getting a little played out, for me at least, and I think a number of people are starting to feel that way as well.

Score: 2 for 4 - It'll get a draw, sure, but I'm interested to see how many actually attend.



5.) It's an odd decision to not include the ability to delete saves in Resident Evil: The Mercenaries 3D.

Todd Vote - Fact: Who the hell made this call? Is this another step to prevent the resale of games? I think that is pretty dirty. Why should the selling of used games be any different than selling movies, or music you do not listen to anymore?

Jimmy Chavez - Fact: Uh yeah it is. I've been reading up on this one quite a bit and I still can't understand why they would think this is a good idea. I really hope they don't make this the norm. If so, sorry to say but I'm not going to be increasing my Capcom games collection much.

Score: 3 for 5 - Capcom says it wasn't because of used game sales, but I can honestly see no other reason.



6.) It doesn't surprise you that 360 owners buy more online games than PS3 owners.

Todd Vote - Fact: Not particularly, no. I think Microsoft has a better online model in place than Sony. That is the one place Microsoft shines.

Jimmy Chavez - Fact: Let's see, should I go the Xbox fanboy way or actually play it legit? Okay legit it is. It may not have always been like this but I can see why with all the recent happenings in the online gaming world. Xbox Live is the premier online service. That's not to say that PSN is bad in any way. It's just more people like what LIVE has to offer. It's not a big difference at all between the two services, but with the recent PSN outage and a number of gaming content coming out on LIVE first, I can see where the appeal for gamers to go with LIVE comes from.

Score: 4 for 6 - Microsoft has always provided a good service with LIVE, and I think gamers like being able to communicate with their friends privately a lot better when gaming.



Bonus Question) LulzSec attacking game companies was pointless.

Todd Vote - I'm not giving hackers the satisfaction of talking about their bullshit tactics.

Jimmy Chavez - Yep

Adam Larck - If they wanted to call attention to security flaws that companies have, there are a lot better ways to do it. Plus, for a group that said they were trying to deal with oppression, a game company seems a poor choice for a target. It seems like these guys were trying taking anger out on losing a game the company made, not trying to do anything noble.

PS3 also has more games that focus on the single player aspect, especially the exclusives, which are mainly RPGS and other games from Japan. The only exclusives on the X360 are Halo, Gears of War, and Fable. Everything else is multiplatform or already has an equivalent on the PS3 (Forza/Project Gotham = Gran Turismo). It's no surprise people buy more 'online' games for the X360 because it's marketed as that, while the PS3 is marketed as a all in 1 home entertainment centre.

Aren't there more 360's than ps3's? Is more spent on online games per console or is it just the total spent by all owners? How much is spent per console online?

Sony didn't care about Hotz hacking the PS3. They cared about him releasing the information to the public. His info allowed people to pirate games, which Sony didn't want.

I can buy a car, mess with the engine, plug in some nitros (or whatever, I'm not a car guy). The modifications I make to it may be illegal (as defined by the state), but it shouldn't/doesn't matter to Ford/Honda/GMC/etc. It is MY car.

Hotz was sued by Sony, not criminally indicted by the State of California or any other jurisdiction (that I have found). While Hotz settled out of court (against a giant like Sony, who wouldn't?), he had many free speech supporters outside of the hacker community. He also had the following to say about the hacking of Sony's database:

"Running homebrew and exploring security on your devices is cool; hacking into someone else's server and stealing databases of user info is not cool".
