[Gossip] Halle Berry Seeking Restraining Order Against Gabriel Aubry

Halle Berry is seeking a restraining order against Gabriel Aubry following his fight with her fiance Olivier Martinez on Thanksgiving. As previously reported, Aubry was arrested Thanksgiving morning after he assaulted Martinez; he was arrested and booked for misdemeanor battery and an emergency protection order was issued by a judge requiring Aubry to stay 100 yards away from Berry, Martinez and Nahla, Berry and Aubry's four-year-old.
While the order of protection expires on Tuesday, TMZ reports that Berry's lawyers are going to family court on Monday in order to make it indefinite. Berry and her lawyers are said to be very concerned over the fact that Aubrey started the fight right in front of Nahla. They will argue that it is too risky for Aubry to be around the little girl (or Berry and Aubry) if he can't control himself enough to not subject Nahla to emotional trauma. Her lawyers have argued in the past that Aubry had a bad temper, which this lends a lot of credibility to.
