UPDATED: [Gossip] Kim Kardashian Wants A Trial Date Set In Her Divorce Case With Kris Humphries

UPDATED: Radar Online reports that Kris Humphries wants the engagement ring back that he gave to Kim Kardashian but she is refusing to return it.

He had a discount on the ring, which was valued at the retail price of $2 million. He only spent $750,000 on the 20.5 carat diamond Lorraine Schwartz ring. He thinks she should give it back.

A source said: "Kris is adamant that he wants the ring back. And it's becoming a real sticking point between his and Kim's attorneys. She has made it plain that she has no intention of returning it though and feels she is within her legal right to refuse as she went through with the wedding. However, Kris contends that the marriage was a total sham and that Kim only wed him for publicity so therefore she has no right to keep such an expensive gift. Kris doesn't understand why Kim would even want to keep the ring anyway. It obviously has no sentimental value as she has publicly declared their wedding as 'a huge mistake' and she certainly doesn't need the money, so why doesn't she just return it to him?"

The two were in court yesterday as we reported, as Kardashian's lawyer Laura Wasser said she was "handcuffed" to Humphries by his refusal to grant a divorce. A source added: "Kris is more than willing, and eager, to end this chapter of his life. But he wants it done on his terms. He thinks Kim tricked him into marrying and he wants his day in court to prove that. There's no ulterior motive, he just wants the record set straight and what he perceives as a massive wrongdoing against him put right."

Original: People reports that over a year after divorce papers were filed, Kim Kardashian's lawyer is demanding a trial as soon as possible to finally end it.

Her lawyer, Laura Wasser, told a Los Angeles Superior Court judge yesterday: "Ms. Kardashian is now handcuffed to Kris Humphries. These delays are forcing her to be married. She wants to dissolve her marriage so she can move on with her life. I don't think [Kris] has a case, it's a fishing expedition. We want a trial because that's the only way this will end. There was no fraud."

Humphries' legal team has been building evidence to prove that the 72-day marriage was a fraud. They have deposed Kardashian's mother, her wedding planner and her boyfriend Kanye West. Humphries is seeking an annulment (used to clear a person's marital record, usually for religious reasons). He has previously said that Kardashian "had no intent of being married" and that it was all "for the benefit of her TV show."

His attorney, Marshall Weller, said: "All she has to do is agree to an annulment [based on fraud]."

Waller was annoyed that "third parties" involved have been slow to give up evidence, including those involved with her reality show. He said that private investigators are being hired to find witnesses. Waller added: "These are people who are hard to locate. Every case is capable of settling before trial."

There will be a hearing on February 15 to see when a trial may begin.
