[Gossip] Attorney Says He Thinks Lindsay Lohan Will Be Exonerated For Assault

The Washington Post reports that Lindsay Lohan's attorney, Mark Heller, expects that the assault charges against her will end up being dropped.

Lohan was charged yesterday with crimes in New York and Los Angeles. Santa Monica prosecutors charged her with three misdemeanors stemming from her car accident in June. Just before, she was arrested in New York and charged with third degree assault (a misdemeanor) after a woman was punched in a nightclub. The California charges came from an incident where her Porsche crashed into the back of a dump truck. She told police her assistant was driving, but police believe she lied. She was charged with lying to police, reckless driving and obstructing a police officer from performing duties.

Lohan's California attorney, Shawn Holley, would not comment on the charges related to the car crash. But her New York attorney, Heller, said he expects the assault charge to be dismissed.

He said: "Once again, Lindsay Lohan is a victim of someone trying to capture their 15 minutes of fame. From my initial investigation, I am completely confident that this case will be concluded favorably and that Lindsay will be totally exonerated."

The charges in California could mean another probation violation, who was ordered to obey every law when she was released from supervised probation in March after being convicted of the misdemeanor theft of a necklace and two DUI charges. She was arrested twice in New York, crashed her car, treated by paramedics in her hotel room and had an argument with her mother that caused a 911 call. Judge Stephanie Sautner warned Lohan that she could spend up to 245 days in jail if she violated her probation. Sautner said: "You need to live your life in a more mature way, stop the nightclubbing and focus on your work."

She has been sentenced to the Los Angeles-women's jail five times. Most of those sentences were cut short due to overcrowding and she was allowed to serve 35 days of house arrest in 2011.

She has been working on reviving her film career, after filming two movies and a cameo in Scary Movie 5. Liz & Dick premiered on Lifetime on Sunday night to negative reviews. She was on her way to shoot that film when the car accident happened. A week later, she was treated for exhaustion and dehydration. She moved to New York after finishing work on Liz & Dick and Bret Easton Ellis' The Canyons.

Police say that on Thursday she had an argument with a woman at Club Avenue and she eventually hit the woman in the face. The woman didn't require medical attention but Lohan was arrested and charged at 4 AM ET. This wasn't her first arrest in the state, as a man accused her of hitting him with her car in September. A month later, police went to her home after she fought with her mother, but police ruled that there was "no criminality."

It's unknown when she will return to LA, as no court date was announced for the charges related to the car crash. Those charged with misdemeanors in California can avoid court appearances if they have a lawyer, but Lohan would have to be there for a probation violation hearing.
