[Gossip] UPDATED: Lindsay Lohan Won't Be in Court Tomorrow

UPDATE: Sounds like Lindsay Lohan's miraculously feeling better. TMZ reports that Lindsay is racing to fly out to Los Angeles tonight after news hit that she may be arrested if her claims of being sick are found to be bogus. As previously reported, Lindsay's new lawyer got a note from a doctor saying that she wasn't fit to fly, but pictures from that day show her out shopping and smoking in SoHo.
Lindsay and Dina have booked a flight to Los Angeles. Lindsay is also reportedly begging Shawn Holley, her former lawyer, to come back as she says she can't stand Heller. However, as previously reported Holley is done with Lindsay.
ORIGINAL: Lindsay Lohan is due to miss her date in court tomorrow. TMZ reports that Lindsay's lawyer Mark Heller has filed documents informing the judge in Lindsay's criminal case about lying to police that she has an upper respiratory infection and is unable to fly for her own safety, as well as the public's. He included an article from the New York Post about the flu epidemic running through New York City at the moment.
However, pictures taken on Saturday, the same day that she was reportedly looked at by a doctor, tell a different tale. The pics show Lindsay on a shopping spree in SoHo, during which she is smoking. It is also worth noting that Heller isn't technically approved to appear on Lindsay's behalf yet. A warrant could be issued for her arrest if the respiratory infection is proven to be untrue.
