Smart strategy...
TMZ reports that prosecutors in Lindsay Lohan's lying-to-police case plan to use evidence that she's lied to police twice before. They are convinced she has told police she wasn't driving when she was before.
She is being prosecuted for telling police she was a passenger in the Porsche that crashed into a truck last June on the Pacific Coast Highway when she was driving at the time.
The prosecutors plan to use two previous incidents:
- In May of 2007, she was stopped in Beverly Hills for driving under the influence when her Mercedes struck a curb at 5:30 AM on Sunset Blvd. She lied and said she wasn't driving.
- In March of last year, She was leaving the Sayers Club in Hollywood in her Porsche right after midnight. She struck a pedestrian and fled. Once again, she said she was a passenger and she wasn't.
Prosecutors will introduce the previous lies under the law that allows evidence of "prior bad acts" to show a pattern of misconduct.
