Was she driving with alcohol?
UPDATE 2:TMZ reports that Lindsay Lohan was allegedly driving with alcohol in her car when she crashed her car in June. TMZ has a copy of the police report for the accident, which contributed to her being charged with lying to police about who was driving, and that the officer reports that a plastic water bottle was lying a few feet from the driver's door. The officer picked up the bottle and, noticing that the liquid was amber in color, smelled it and determined that it was an alcoholic drink of some kind, possibly wine.
The officer says in the report, "It was my opinion that one of the occupants ... was possibly in possession of the open container and discarded it shortly after the collision."
Law enforcement sources believe that it was Lindsay's.
UPDATE: Lindsay Lohan's father isn't the biggest fan of the lawyer who helped her avoid jail time. Perez Hilton reports that Michael Lohan loudly heckled Mark Heller at the press conference after Lindsay's hearing in which she agreed to a plea deal to serve ninety days in rehab instead of doing jail time.
Heller was explaining that Lindsay's record would be wiped clean after her rehab was done when Michael began shouting, "Why are you still up there?? I wanna know, why are you still up there?!?"
Heller proceeded to walk away as Michael contiued to berate him; Michael then took the press conference over and told the press, "This guy is trying to cash in on my daughter's notoriety for his own professional interests." Michael said that Heller owes him money but noted that the important thing is that Lindsay is "getting better and getting her life back."
ORIGINAL: According to TMZ, Lindsay Lohan has avoided jail time by agreeing to a plea deal. She pled no contest to the crimes of reckless driving and lying to cops, and will have to serve 90 days in lockdown rehab. In addition to rehab, Lindsay will perform 30 days of community labor and undergo psychotherapy for 18 months. She will be credited for any psychiatric time she recently completed.
The usual sentence, a mandatory 5 days in jail for reckless driving, has been folded into the rehab stay. Lohan will be allowed to do her rehab in New York, has been instructed to stay clear of drugs and drug users, she must submit to drug testing and the judge even suggested that she not drive.
