Morgan seeking unspecified damages...
The New York Post (via TMZ) reports that Tracy Morgan has filed a lawsuit against Walmart as being responsible for the driver behind the wheel in his recent accident. Morgan filed suit in New Jersey and alleged that the company should not have allowed truck driver Kevin Roper to drive for nearly 10 hours straight after being awake for more than 24 hours.
Morgan claims in the suit that he sustained "severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation." The lawsuit also says Roper had driven 700 miles from his home to the Walmart distribution center before he began his fatal driver. Roper was reportedly driving at 65 MPH in a 45 MPH zone and slammed into Morgan's SUV.
Roper pled not guilty to charges of death by auto. Morgan was recently released from the hospital, but he is still undergoing physical rehabilitation. Morgan and three other plaintiffs are seeking unspecified damages.
Walmart stated in response to the lawsuit, "As we've said, we're cooperating fully in the ongoing investigation. We know it will take some time to resolve all of the remaining issues as a result of the accident, but we're committed to doing the right thing for all involved."
