STUFF I WANT TO TALK ABOUT

Welcome back to the Music 5 & 1, boys and girls! I am Jeremy Thomas and I imagine many of you are in post-Super Bowl bliss or despair. Congratulations to the [MAKE SURE TO INSERT TEAM NAME IN HERE AS I COULD CARE LESS ABOUT THE GAME]. ...oh hell, looks like I forgot to change that out. Well, congratulations winning team and fans of said winning team! And now that we're done celebrating the achievements of other people, let's get to the girls and gossip for the week!








It was another lopsided victory last week, as Fergie took an easy first step toward the Hall of Bang by trouncing Nicki Minaj 196 - 73! She may not have it quite as easy this week though, as she faces someone who I get a surprising (to me, anyway) number of requests for inclusion in Vs. She became famous through her use of MySpace as way of promoting herself and pretty much blazed the way for the celebrities who maintain their fame through sending hot pictures via Twitter. She's been part of a few bands and has released two EP's of her own, 2007's Sex and 2010's Welcome to the Dark Side, and she's Fergie's opponent this week: Miss Tila Tequila! Being a Music Zone, you would think that we have a lot of people who love to talk about music. You would not be wrong. As such, when an album comes out that we have something to say about, we just can't help ourselves. We call that the Review Section…not the most original name, but it gets the point across! Anyway, the review section is a great place to find new music as we cover all sorts of genres and styles, from mainstream artists to lesser known acts. Here's an overview of our latest reviews.

The Big Pink - Future This (8.2)

Craig Finn - Clear Heart Full Eyes (7.5)
"Most famed as the lead singer and songwriter of The Hold Steady, Craig Finn has become something of an elder statesman of rock music these days. With Clear Heart Full Eyes he wields that status like a weapon, letting each lyric drop with the significance of a psalm. I think I'd like a second helping of that Kool-Aid, Mr. Finn. This is a must listen for any Finn fan and worth checking out for everyone else." - C.A. Bell



Seal - Soul 2 (7.0)
"Seal's foray into soul is not bad at all. Maybe there are some ill-thought-out ideas here and there, but this sounds fine when it's playing. It's just that it's not something you'd go out of your way for unless you're the sort of person that requires every resulting sound of Seal's vocal cords being in the general vicinity of a microphone. Soul 2 is one for the fans, then, although his interesting approach to "What's Going On" is worth hearing." - Wyatt E.



Imperial Teen - Feel The Sound (8.5)
"Feel The Sound is not a record for fans of the aloof and droopy. This is plenty of fun and well worth the five year wait. Imperial Teen's game hasn't gotten old in fifteen years and for good reason, they wait until they actually have something to say. I'll stand behind a record like this any day of the week." - C.A. MUSIC VIDEO A-GO-GO

Okay, so who's a fan of 1990s alt-rock? If you are, you probably remember Soul Asylum. The band is still making music to this day, but they will always be remembered for their 1993 hit "Runaway Train" from the album Grave Dancers Union. The song itself was already on its way to being a hit when the band released the music video which had instant worldwide recognition for its featuring of a total of thirty-six different missing children across multiple versions over the world. Many of the missing children have been found due to the attention they got in the video; some unfortunately not alive. It's one of those videos that most people will never forget and it's our video selection of the week.

You know what time it is, folks...these are the stories that I found worth touching on but didn't quite make the Top Five and thus become little bites of snark as opposed to a full course of it.

Lady Gaga is More Indie Than You
Lady Gaga is a lot of things to a lot of people. Provocateur, icon, trashy, crazy, fame whore...all labels used to describe our favorite pretentious pop star. Alex Trimble of Irish indie rock band Two Door Cinema Club has another label: Indie Rock Champion. Trimble recently praised Gaga for giving attention to indie bands, such as Wild Beast who did a remix of "You and I." "It was a really nice thing to see that she was getting a lot of indie artists to remix her stuff," he said. "I thought if she was doing a remix album she'd have people like David Guetta or Tiesto, so it's nice that she's taking lesser known acts and independent artists, and is giving them exposure." All credit to Gaga for doing such to be sure, but I don't think I want to see her go too much more indie than that; the only thing potentially more pretentious than Lady Gaga is Hipster Lady Gaga.

Miley Cyrus Proves She Can Bust Her Ass
Just maybe not in the good way. Miley Cyrus recently had what for most teenagers would be a typical mishap stemming from a bit of poor judgment made on the fly. Of course, most people wouldn't tweet it out to millions of people, but most people aren't Miley Cyrus, who posted that she "cracked my tail bone doing a front flip... on to the couch. thats like when i tripped over a pillow and broke my arm. With all due respect to Miley, I'm sure it's not the first time she's ended up having to walk carefully and sit down gingerly, so I'm sure she'll recover quickly enough.


What? I just meant that she had to be careful with that peacock tail. Sickos...



Lil' Kim Owes the Government a Million Bucks
Hip-hop's deposed queen Lil' Kim has more to worry about than just reclaiming her throne from Nicki Minaj. Kim has found herself in dept to the federal government to the tune of a cool million bucks. As it turns out per documents that were filed with the LA Recorder's Office, Kim still owes taxes for every year between 2002 and 2009, totaling $1,026,862.42. Personally, I think the most surprising news out of this is that Kim actually made money between 2002 and 2009, considering that she hasn't been remotely relevant since 2001.


Perhaps she made her money in non-musical ways.



LeAnn Rimes Sending a Sick Girl to Disneyland
Country star LeAnn Rimes gets a lot of crap from the internet because of her affair with Eddie Cibrian while both she and Eddie were still married. However, she earned herself a little goodwill this week when she committed to sending a six year-old girl who is going blind due to septo-optic dysplasia to Disneyland. LeAnn announced that she's working with American Airlines to help the girl, whose parents launched a fundraising website to help send their daughter to meet Mickey Mouse, to organize the trip. That's the kind of thing you have to respect and unabashed kudos to Miss Rimes for doing so. Of course, will anyone be surprised if we later learn that the father is leaving his wife for a little "How Do I Live" action? I didn't think so.


Come on, was I really going to pass that joke up? I think not.



Frances Bean Cobain Says Her Mom is a Murderer
Although to be fair, not in the way that most people think she is. Frances Bean Cobain filed a restraining order against her famously drug-addled mother Courtney Love in 2009, which at the time was said to have had to do with domestic violence. What no one particularly expected was that at least some of the violence now appears to have been directed at Frances Bean's pets. In a sworn deposition recently unsealed, Frances Bean accused Courtney of being responsible for the death of a cat and dog belonging to the teen. The cat apparently died after getting entangled in piles of fabrics, boxes of paperwork and other assorted trash around the place while the dog died after swallowing pile of Courtney's pills. I'm putting money down on the eventual reveal of a suicide note attributed to the dog which may or may not be in Courtney's handwriting.


Self-inflicted, my ass.

Amy Winehouse's Death Drama Drags On

It seems that no major celebrity death can ever be a conclusive, controversy-free situation. There are always questions that arise, controversy and such when someone passes away in an untimely manner, but why is it that celebrity deaths so often seem fueled by missteps, errors and flat-out bunglings from the authorities? Case in point: Amy Winehouse. Amy's death in July was a huge story of course, but like many such deaths took a long time to get resolved as to the definitive reason behind it and even after, it seems little tidbits are coming out that cast doubt on what was eventually determined. The official inquest into Amy's death took place in October but was delayed after, of all things, a confidential report regarding her death was accidentally sent to the wrong address. Now, three months after the inquest determined that Amy had a lethal quantity of alcohol in her system, a new controversy is coming forth as it turns out one of the coroners was not considered to be a qualified medical professional.


I can't imagine what their first clue was.


Disappointingly, the coroner in question was not Christina Aguilera, but instead Suzanne Greenaway. Greenaway is the wife of Inner North London coroner Andrew Scott Reid and was appointed by said husband to the position of Assistant Deputy Coroner while he was conducting the inquest. As it turned out, this little bit of business was not only incredibly nepotistic, but also illegal because Greenaway was discovered to have not met the requirements that go with the appointment of coroners. Greenaway could only have been appointed if she had been in the Law Society as a solicitor for at least five years, and she only joined two and a half years previously. She also doesn't have the required five years as a "qualified medical practitioner," meaning that each of the thirty inquests she was a part of could be deemed as illegal if they are challenged in high court.

Reid backpedalled over the whole incident, saying, "In November it became apparent I'd made an error in the appointment process. While I am confident that all of the inquests handled were done so correctly, I apologise if this matter causes distress." Yes, an "error in the appointment process" is exactly what I would call it. Another way to refer to it is "you thought you could pick up an extra household paycheck and maybe score some fidelitous late-night office sex and either didn't bother to read the basic qualifications for the position or just hoped no one would notice." Now I understand that oversights can happen. However coming at this from an ethical standpoint, I know that when you're doing something that could potentially be a conflict of interests--such as, say, hiring the person who you're having naked sexy time with on a regular basis--you are advised to be more thorough than normal just to make sure that no one can question things. Clearly as I said, either that wasn't done here or Doc Reed hoped no one would notice. Either way it's a move that goes beyond boneheaded into flat-out moronic, and one can imagine that the now-launched investigation into Reed's actions won't end well for him.

Meanwhile Amy's father Mitch Winehouse said that the family were seeking legal advice over the matter. "It's hard to believe her credentials weren't fully checked," he said. "You'd assume this sort of thing can't happen. We've been informed the coroner was taking guidance from more experience professionals and the verdict doesn't appear to be in any doubt, but it's upsetting to have to go through all this again. We just hope that matters can be resolved soon." I actually have a fair amount of respect for Mitch and his family, who have handled the last six months remarkably well. If I were in that position and I found this out I would have flown off the handle, potential PR mess be damned. I normally have a fair amount of sympathy for those involved in high-profile death investigations; the spotlight is on them and their every action is carefully scrutinized and the pressure can lead to mistakes what may look damning but are understandable. This is clearly not one of those times and while I imagine the Winehouses will avoid challenging the inquest for the sake of their own peace of mind, I wouldn't be stunned or particularly blaming if they filed a lawsuit of some kind over the situation.

Drake and Eminem Sued By Crazy People

You know what I hate? If you said "all of Justin Bieber's so-called music," you would be accurate, but I was thinking more specifically of sketchy lawsuits. I know I just said I would sue if I was the Winehouses, but I consider that level of incompetence a very real reason to sue. On the other hand, Drake and Enimem were subjects of lawsuits that in my not-so-humble opinion stand on much less even grounds. Let's get to Drake's first. The rap star was hit with litigation from an alleged ex-girlfriend named Ericka Lee who claimed that she co-wrote and performed on his song "Marvin's Room," which hit #7 on the Billboard R&B/Hip-Hop Songs chart. In the song, Lee is the voice on the other end of a phone while Drake rants that he is better than the guy she has replaced him as. According to Lee, the two had a romantic and business partnership between early-2010 and mid-2011, during which the two worked on "Marvin's Room" among other songs. Lee says that Drake agreed to split the profits with her and asked her to perform the hook and opening monologue, which she did. However, the two broke up after the song's release and Lee says that he stalled her, promising her first 2% and then 4-5% of the profits from the song, the latter in addition to a $50,000 payout. She's demanding to be named a co-writer to the song, damages and disgorgement of profits on allegations of breach of fiduciary duties and unjust enrichment. Interestingly she's being represented by Neville Johnson, who previously filed a lawsuit against Drake on behalf of Playboy Enterprises for sampling an unauthorized sound recording it owned on "Best I Ever Had."

Drake's version, as you might imagine, is a little different. His rep said, "This claim is entirely without merit and our client has not engaged in any wrongful conduct. Ericka Lee consented to the use of her voice in the song 'Marvin's Room' prior to its release. Lee asked only for the credit she received as 'Syren Lyric Muse,' and she did not ask for any compensation. It was only after she retained a lawyer that there was a demand for payment. Drake tried for months to resolve the matter amicably, and he now looks forward to being vindicated in court."

Now call me a little bit skeptical, but as a general rule it seems like whenever there is a claim of something like this, the plaintiff usually ends up losing out when it actually goes to trial. Yes, most of the time it is settled out of court rather than go to judgment, but that's mostly because record label lawyers like to play it safe and are worried about setting precedent for future lawsuits. Nine times out of ten, the people making the lawsuits have found themselves in a grey enough area of "he said, she said" to make just enough of a case to not sound 100% implausible and that's enough to roll the dice, hoping that a jury will be sympathetic to the "young artist" fighting against the "rich celebrity." All the information from this appears to be that exact situation and while I am not a big fan of Drake's overall, I hope he actually fully fights this one and if he's not guilty of what he's being accused of, he puts her directly in her place.


Drake is not amused.


Now let's move onto good old Slim Shady himself. Eminem has been sued by a homeless man who claims he provided the idea for the 2011 "Born of Fire" Super Bowl commercial. The commercial was made for Chrysler, if you will recall, and features Em's "Lose Yourself" as a background and Em himself as it extols Detroit's auto reputation and the Chrysler 200. According to Stephen Lee Pieck's handwritten lawsuit filed at the United States District Court in the Southern District of New York, Pieck was having dinner with Christina Aguilera and her then-husband Jordan Bratman in White Plains, New York On September 9, 2010 when Christina called Eminem and then handed the phone to Pieck. Pieck, in the words of the lawsuit, "told [Eminem] based on the fact that his song beautiful conversation has information pertaining to the manufacturing industry and what a bad state the city of Detroit is in, he should do the commercial. Marshall Mathers then asked me for ideas and how he should proceed with the commercial. I told him that the opening scene should have him standing in front of a stage and a choir wearing red should be standing on top of the stage. I also told him that his opening line should be, 'This is what Detroit is about, and this is what we do.'" I could go on, but I don't have the patience to correct his grammar (and the "song beautiful conversation," for the record, is not a typo by me). Basically he more or less describes the video and says that Eminem agreed to pay him 50% of the profits he was paid by Chrysler.

So forgive me for jumping the gun on this one, but somehow there are a few details in her that don't quite seem to add up. First off, I'm fairly sure that Christina and Eminem are probably still not on speaking terms over that whole line about her performing oral sex on Fred Durst and Carson Daly. Second, considering that Christina and Jordan separated on September 11, 2010 they probably weren't having random dinner with homeless guys on September 9th. Third, Stephen Lee Pieck appears to be batshit insane. He listed two phone numbers in the lawsuit; the first was that of his mother and the second was a cell phone answered by an unnamed woman who hung up when called about it. Also, handwritten lawsuits are not usually the sign of a solid case; more commonly they're the sign of a case that no sane lawyer would touch, sending the plaintiff to file the inane ramblings on his own. I guess it could be worse for poor Eminem though; at least he's not being sued for a trillion dollars like Diddy for allegedly causing 9/11 and stealing a poker chip worth "100 zillions of dollars."


Mo' money, mo' problems indeed.





Speaking of Retarded Lawsuits...

Seriously, it's lawsuit week here at 5 & 1 Headquarters. Not only were Eminem and Drake sued this week, but Madonna found herself at the business end of a lawsuit threat from the one and only Joe Francis. If you don't know who Joe Francis is, then consider yourself lucky. He's the man behind the Girls Gone Wild phenomenon. You know the one...the videos where he convinces drunk women at Mardis Gras or spring break to drop trou and raise shirt for a T-shirt, then go back to a hotel room and do something that they will forever pray their parents don't see on late-night infomercials. For the record, he also does Guys Gone Wild for the ladies; yes, he's an equal-opportunity offender. Joe threatened to sue Madonna, NBC and the NFL if they ran with the song "Girls Gone Wild" off the Queen of Pop's new album MDNA, sending them a cease and desist letter that accused them of trying to get a "free ride on the valuable consumer goodwill and brand recognition" of his company.


I don't know what's funnier: this picture or the idea that
GGW has any kind of goodwill, consumer or otherwise.


Of course, as angry and offended as Joe is, he's not unreasonable. Not at all...in fact, he's willing to cut the Material Girl a deal. According to Francis' lawyer, Joe will back off if Madonna negotiates an immediate licensing agreement for the use of Joe's trademark, accounts for the number of times Madonna has already used the trademark and doesn't perform it this weekend at the Super Bowl. What a nice guy he is. Thus far he's gotten one of his demands as a rep for the singer said that the song will not be performed at the Super Bowl...and more specifically, it never was. "It was never a possibility," said the rep. "She has confirmed she will be performing her new single and three of her gems from the past." Some people might accuse Madonna of backpedaling here, but let's be frank; if you just released the first single off your album in conjunction with your heavily-publicized Super Bowl halftime performance, are you going to do that single or some song that won't even be available to listeners until March when the album is released?

I've called Madonna out on bullshit before, and I'm certainly not hesitant to do so when she's deserving of it. But in a war between Joe Francis and Madonna, Madonna is generally going to win a credibility debate in my mind. I have nothing against commercial videos featuring hot women in various states of undress, but Francis is one of the most morally abhorrent men not doing time for sexual assault or serial murder. Francis' methods are repulsive and his inability to prove that his subjects were of legal age has proven what a waste of flesh he is, not to mention his income tax fraud, allegations that he physically threatened women making complaints against him and more. But this isn't even a case where you have to make the argument by sheer virtue of Francis' douchiness. Madonna's use of the phrase in a song title can quite potentially be considered fair use depending on the nature of the song, particularly since it's probably not derivative--in other words, it probably doesn't rip off the GGW concept. Additionally, I'm pretty damned sure that people aren't going to give the song more weight than it otherwise would have, or be more likely to purchase it or the album, because the title is a reference to substandard skin videos. I have a feeling Joe's going to be on the losing end of this one, and he probably knows that himself. He's just looking for a little free publicity and it seems like he got it.


If Madonna couldn't sue over "Born This Way" then Joe's out of luck.





Katy Perry In Talks for a 3D Movie

People who have been praying for a more "in your face" Katy Perry are about to get their wish. Katy is reportedly in talks with Paramount Pictures and Imagine Entertainment, to make a documentary-style 3D film about her. Paramount is looking to replicate the success it had with Justin Bieber: Never Say Never which released last February and grossed $98.4 million worldwide on a mere $13 million budget. The deal is said to be in the early stages so far, with no director on board, but insiders say that it's just a matter of logistics and time before it happens. Katy is considered to be a prime subject for a 3D film, considering the mega-success she's had over the past couple years and her core audience falling along the same lines as the Biebs, not to mention the fact that her concerts tend to be very visually colorful and dynamic.


I can think of two assets she'll bring to 3D that Justin didn't.


Concert films seem to be on the rise as of the last few years. Following a long period of relative silence, the genre made a comeback in 2008 when Disney hit big with Hannah Montana / Miley Cyrus: Best of Both Worlds Concert Tour which surprised people with a $65 million gross. The studio repeated the success with Jonas Brothers: The 3D Concert Experience, with Michael Jackson's This Is It and Never Say Never following suit. A recent sputtering out by Glee: The 3D Concert Movie obviously hasn't soured studios on the concept, which generally costs very little in comparison to the grosses received. Concert films are much like horror films in that way, in addition to the fact that they generally elicit screams from the audience. On top of that, her performances and style are so colorful and visual that they may lend themselves to the cinema experience.

Personally, I am not a huge fan of concert films as a whole. There are certainly some that I've liked; I quite enjoyed the Rolling Stones' Shine a Light, U2: Rattle and Hum, Neil Young: Heart of Gold and several others. But a concert documentary often ends up being like getting stuck outside an actual concert and viewing it on a monitor instead. You get the sense that it's a great place to be, but there is an energy and vibe that gets in the fact that you aren't actually present. It's the same reason I don't generally (with some exceptions) dig on live albums; it just ends up being a watered-down experience from actually being there.

Of course, a big key is whether you're a fan of the artist in question. Never Say Never, Best of Both Worlds and Jones Brothers 3D had zero chance to score with me because I don't like Bieber, Miley or the Jonas' as musicians. Katy I'm lukewarm about as an artist; I think she makes acceptable but generally middling pop and while I find it listenable I don't typically go out of my way to do so. That being said, I think it's a smart move for her. She's currently smarting from her divorce from Russell Brand and she could use some good press out there, and a 3D concert film would definitely do that for her. She may not have the obsessed fanbase that Bieber has, but she does also have a wider fanbase as her record sales and string of hits can attest to. Guys may be more willing to go so they can catch the promise of some sexy 3D visuals and so I have no doubt that this will be a success. You can bet that I won't be there, but more power to Katy for giving it a go.


If she performs dressed like this, I may change my mind about not going.


Cheryl Cole Suing Over MC Harvey Relationship Claims

Celebrities get so much crazy shit reported about them, it's often easy to be skeptical about the stories. And often the celebrities don't bother to comment because frankly they feel it's not worth their time and usually there's no putting the genie back in the bottle, even if the genie doesn't really exist. As it turns out, Cheryl Cole is not one of those celebrities. Cheryl is reportedly suing Now magazine over claims from rapper MC Harvey that he and Cole were dating in 2010. It all began when Harvey told the magazine that he and Cheryl "shared a special bond" and were confidants during the end of Cole's relationship with notorious douche Ashley Cole. Harvey said that he would have married Cheryl had she not moved to the US for that whole X Factor fiasco. "There was a relationship and an attraction to each other's aura," he said. "She's a good girl. We've got a great respect for each other."


Good girl gone bad, I'm assuming.


That "great respect" seemed to quickly evaporate (assuming it ever truly existed) when Harvey opened his mouth. Cheryl, who tends to keep her Twitter feed reserved for supporting messages to her Girls Aloud mates and answer fan questions, did what is best described in a technical manner as "losing her shit," sending a cavalcade of rants at Harvey. "Was this "relationship" happening in your head [Harvey]?! Are you smoking something ?," she asked. "I think I've met you once maybe twice at public events and With your wife!! #shitjustgetswierder" She's now suing Now for publishing the comments, although the magazine is standing by its story, mostly because it reported the comments from Harvey accurately. Cheryl doesn't have much of a case against Now, but Harvey on the other hand is probably another matter. This is why you don't try to talk shit; because it will come back to bite you in the ass when someone decides they're not just going to be the bigger person and sets out to prove a point. It could be Justin Bieber, it could be Cheryl Cole, but whoever it is, you won't end up the better in the end.

As an amusing side note, Harvey tried to counter the twitter rant by saying, "Do you actually want me to tweet some of the messages you emailed me pipe down and stop playing the saint in front of your fans.
