Kanye West and Jay-Z Respond to Illegal Sampling Lawsuit

They claim they’re not at fault…
According to The Hollywood Reporter, Jay-Z and Kanye West have responded to the illegal sampling lawsuit brought forward by soul musician Syl Johnson. They claim that what was sampled isn't protectable by copyright laws, and that they're not at fault.
Their answer has been filed by their lawyer:
"Any claim based on the alleged use of Plaintiffs' recording is barred because, inter alia, (a) the allegedly copied portion of the Plaintiff's recording is not part of the musical composition; and, if it is part of the composition, (b) is not protectable and/or (c) any use was de minimus."
