Lawsuit Against Lady Gaga Over Cheated Overtime Going to Trial

A lawsuit against Lady Gaga over a claim of unpaid overtime is headed to trial. Billboard reports that the suit, which was filed by a former friend and roomate of the singers, will begin trial on November 4th.

The trial was brought by Jennifer O'Neill in 2011, claiming that she was on call for Gaga for 24 hours a day, seven days a week for one to two months in 2009 and thirteen months beginning in February of 2010. Both sides agree that O'Neill was expected to be available as needed throughout each hour of each day, and that the time potentially qualifies for overtime compensation.

O'Neill said that she was paid $50,000 in a flat fee annually when first hired and $75,000 annually for the second hiring. The judge noted that lawyers said that Gaga and O'Neill frequently slept in the same bed on tour due to the fact that O'Neill didn't have a hotel room and was required to handle the singer's needs throughout the night. Among O'Neill's claims was that if Gaga was watching a DVD in the middle of the night and got tired of watching it she would wake O'Neill up to replace it with another one.

Gaga testified in a deposition, noting, "You don't get a schedule. You don't get a schedule that is like you punch in and you can play ... at your desk for four hours and then you punch out at the end of the day. This is when I need you, you're available."

The trial will be held by jury, with a trial date set for November 4th.
