UPDATEDx2: Police May Have Lied On Report About Justin Bieber's Sobriety

UPDATE: The ACLU claims that Justin Bieber is getting special treatment in his arrest. Radar Online spoke with ACLU Policy Counsel Chris Reckerd, who says that Bieber's status as a Canadian citizen is largely being ignored where most immigrants would be facing potential deportation.

Reckerd said, "The average person who's susceptible to this won't have the resources to get the legal representation [that Bieber has]" and could be indefinitely detained while ICE determines their fate independent of any criminal proceeding. When [Bieber] was arrested and booked, his fingerprints would have been shared with ICE. They would run his fingerprints and show that he was here on this [work] visa."

Reckerd added, "What's really important for him right now. is he has to have the best criminal representation, to make sure any conviction he comes to doesn't jeopardize his ability to stay in the U.S. and work here...Someone with less means won't have the same leverage to bargain and won't have the same time with an attorney. People have to pay for their own attorneys, which is a disaster, Many people don't even get a day in court for immigration, because the law is so strict about automatic deportations and automatic detentions."

In regard to Bieber's situation as compared to normal immigrants, Recked says "It's a huge disconnect."


ORIGINAL: TMZ reports that Justin Bieber may not have had any alcohol in his system when he was arrested yesterday, even though police said that he smelled of it when they arrested him.

His blood alcohol level was 0.014 which isn't anything at all. Legal intoxication is .08. Police said yesterday that he had a .04 but this isn't the case. Someone the size of Bieber would have had higher than a .014 with a single beer, so this seems that someone messed up with the police report.

The arresting officer claimed to lean into the car to speak to Bieber. The officer said: "I immediately smelled an odor of alcohol eminating [sic] from the driver's breath."

Bieber was arrested and taken to a holding facility where another officer agreed that he smelled "the odor of an alc bev on his breath." Bieber said at the scene that he was not drunk, but police said he failed his field sobriety test.

This could come to down to credibility, which the Miami Beach PD has had issues with in the past. Bieber's people are accusing the police of lying. A source said: "That police force has had a zillion problems."
