DA Office Stuck on How to Prosecute Justin Bieber in Egging Case

They can't decide...
Justin Bieber's egging case has been going on for over six months and still he hasn't yet been charged. TMZ reports that the Los Angeles County DA's office hasn't yet decided on how to proceed with the case. The site notes that subordinates to the District Attorney are unsure whether to file it as a misdemeanor or felony--not a surprise at this point, as they've been held up for all this time on that very issue.
The case should be prosecuted as a felony by law because the damage was well over the $400 that the law prescribes. However, there is concern that a felony would look like they're trying to nail him too hard because he's a celebrity, while a misdemeanor would look like they're taking it too easy on him. There is video of him taunting the neighbor who was egged in the middle of the attack so he was clearly involved.
The prosecutor in the case has sent it to his superiors and recommended that a felony by filed. As of yet, obviously, that hasn't happened. The DA's office has been silent as to the cause of the holdup.
