Federal Judge Blocks Embryonic Stem Cell Research Funding – First Time Government Spending Has Been Cut in History of Universe

We’re born with pain
If you're like me – and who isn't now and again – you haven't thought much about the moral implications of embryonic stem cell research in some time. The issue of embryonic stem cell research is a relic of Pre-9/11 America, and like former California Congressman Gary Condit, it's quaint to think how it once captured our imagination. Then-President George W. Bush's decision to limit embryonic stem cell research seemed well-reasoned, thoughtful, and nuanced – even to those who disagreed with it. It was a heady time for the Republic.
This week, a federal judge granted a preliminary injunction that effectively blocks federal funding of embryonic stem cell research, and reverses an executive order by now-President Barack Obama. Well, that's an unexpected development, no?

You can read Chief Judge Royce C. Lamberth's ruling in PDF format here. At 15 pages, it's not so bad. Much of it is concerned with interpreting the relevant federal law restricting funding of embryonic stem cell research, which happens to be called the Dickey-Wicker Amendment. What a delightful name. Sounds a bit like British slang for an impolite sex act. Excuse me while I type "Dickey-Wicker" into Google's image search and see if anything good comes up.

The shadow of the wicker man is rising up again
Apparently, the language of Dickey-Wicker clearly states that no federal funds can go toward research involving the destruction of a human embryo. In his ruling, Judge Lamberth (custom requires I note he was appointed by Ronald Reagan) declared for the record that stem cell research is harmful to an embryo's health, to wit (p.12):
If ESC [embryonic stem cell] research is research in which an embryo is destroyed, the [Obama administration] Guidelines, by funding ESC research, violate the Dickey-Wicker Amendment.
ESC research is clearly research in which an embryo is destroyed. To conduct ESC research, ESCs must be derived from an embryo. The process of deriving ESCs from an embryo results in the destruction of the embryo. Thus, ESC research necessarily depends upon the destruction of a human embryo.
Despite defendants' attempt to separate the derivation of ESCs from research on the ESCs, the two cannot be separated. Derivation of ESCs from an embryo is an integral step in conducting ESC research. Indeed, it is just one of many steps in the "systematic investigation" of stem cell research.
Regardless of the moral implications, it's now a matter of federal jurisprudence that embryonic stem cell research destroys embryos. While that may seem like a clumsily-worded statement of the obvious (ahem), it's always worthwhile to pause and reflect whenever the government expresses its view on the sanctity of life.
Any question regarding the beginning of human life is perplexing and loaded with uncertainty. Those of us who are pro-abortion certainly have a different perspective than those who are pro-life. Ultimately, there are a lot of heartfelt, deeply personal opinions surrounding these issues, which may be an indication we should give government as little regulatory authority as possible in such areas.
Still, the amount of authority the government should have will always be a vexing question. If you believe what you read in the papers, embryonic stem cell research may have better healing powers than Jesus. Some of our elected representatives seem to think so:
Democratic Senator Tom Harkin, who chairs the Senate Health, Education, Labor and Pensions Committee, said he was calling a hearing for Thursday on the matter.
"This ruling should be appealed and I fully believe that it will be overturned. Embryonic stem cell research offers hope to millions of Americans who are suffering from debilitating and life-threatening diseases, and it must be allowed to proceed," Harkin said in a statement.
Who can put a price on hope? For that matter, who can adequately define hope? It's a notoriously subjective/flexible concept.
"I can put a price on hope - $1,000,000,000,000, suckas!"
I'm not an expert on embryonic stem cell research (one of the many things I'm not an expert on, despite having an opinion). I'd venture Sen. Harkin isn't much of an expert either. In fact, I get the impression supporters of embryonic stem cell research oversell the upsides just a bit. It's all very enchanting speculation, but it's speculation nonetheless.
Despite its as yet unfulfilled promises, I don't have any particular objection to embryonic stem cell research. My personal moral compass is not, perhaps, as generous as others' on the question of the value of human life at such an early stage. Many patriotic Americans think the destruction of an embryo is tantamount to murder, but that simply is not a view I share. With that in mind, generally speaking I don't expect I would support most government limitations on embryonic stem cell research.
But the question of funding is a-whole-nother issue. With America's preposterous debt, we should all be grateful for any proposed spending cuts, even those created by activist judges. Since private funding for embryonic stem cell research will continue, I have a hard time believing money spent by the feds is the make-or-break factor in the research bearing fruit.
Insofar as Judge Lamberth's ruling temporarily stops spending money on something that could just as easily be funded by the private sector, we might as well be grateful. There are so few opportunities to feel that way about the government – let's enjoy them when we can.

The assumption that the private sector will pick up the slack is unfounded, as the private sector is broke too. Public funding has also always made up a large part of stem cell research funding, mostly because there isn't enough funding coming from private sectors.
This hurts stem cell research, no question.
I'm not sure this'll even cut the budget deficit, as I'd imagine the budget to be given out in research grants was already set. I'd imagine the money will just go to some other research programme.

That is generally how I feel. It is a personal matter between the father and the mother.
However I dont think that late abortions should be allowed (like 6+ months into the pregnancy). I also think that a big danger for no regulation could grow if kids keep having sex, getting pregnant, and then have abortions to fix their "little dilemma". The idea that there would be no responsibility for such immature choices is scary to me.

It's immoral to use the stem cells to try to cure diseases, but it's morally acceptable to throw them away? Because, you know (of course not, because you're a moron who doesn't actually do research), they throw these embryos away when they go unused.
The judge might be on solid legal ground here, but to be against attempting to help people by using what would otherwise be discarded material is akin to being against organ donation upon death.

Third, the only reason why Obama wants to do this shut us because he likes killing babies- look at his voting record- he loves it.
I love science more than anyone, but science, especially medicine has moral obligation to not turn our society into a bunch of ghouls waiting for babies to die so we can get a liver transplant or cure a genetic disease.
Maybe the judge overturned the ruling because Doctors were against the practice, especially since it has never worked and adult stem cells do?

If he was an officer in the military, he has to have a college degree. The military also pays and values education.
I am an officer in the Navy and I have an undergrad Biology degree, as well as a Law degree. I am planning on getting an MBA in the next several years as well.

To give a real answer: Checks and Balances. The Constitution has 3 branches of government that are supposed to actually be set up to oppose each other.
To "keep them honest" to turn a phrase. If it's worked or not is another discussion.
The Judicial Branch has the right to hear cases on Legislation and then determine if the Legislation is Constitutional.
If it's deemed unconstitutional for whatever reason it is no longer law.
The check on the Judicial Branch is that the President choices them, the Congress approves them, can form lower courts beneath them and can impeach them.

Great display of tolerance. It's great to see that the people who preach we should be tolerant of everyone, refuse to tolerate Christianity and people with morals. I guess morals makes us intolerant of other people, but being immoral makes YOU intolerant of us....so it sounds like we are at a stand still. Just don't go around thinking you are the good guy, because you are not. While Christians should be more tolerant of the people doing the wrong doings, they do not and should not have to be tolerant of the wrong doing. For example, people who disagree with abortion SHOULD NOT blow up abortion clinics, write death threats or hate mail to the doctors who perform them, or hate people who have them. I should love those people like I would anyone else, but I shouldn't have to be okay with abortion or agree with it.

Thank you for illustrating my point. The President of the United States of America writes no laws. He is a signature to the Legislature. Nothing more; nothing less.
Bush sucked... and the last two years he was in office he was just signing or vetoing laws from the Legislature...

I have tried to be tolerant man. I really wish you're side would. I couldn't care less what you think of abortion, or people that have abortions. You can think they are complete monsters all you want. That is your right. What is NOT your right is to force your religiously based moral viewpoints on people who don't share them. I would never want to make it a law that Christians who get pregnant unexpectedly would have to get an abortion, however, your side wants to make it illegal for someone not sharing your values to obtain the procedure. This ruling is of the same cloth, the only people that care about the embryos are people who believe life begins at conception, I do not, and therefore I don't agree with this ruling. The bible is not the constitution, and we are not a theocracy, no matter how much you hardcore Christians seem to want that. You have just as much right to hate abortion because Jesus says so, as I have every right to be an atheist and believe otherwise. That said, your opinion does NOT hold more weight than mine in a free country.

Way to avoid the issue, Grant. Probably because you don't want to have to deal with it, the same as other conservatives who say abortion is murder (the destruction of a fertilized egg within the first 3 months of gestation) yet are fine with artificial insemination, which can lead to several fertilized eggs - most of which are either destroyed or frozen indefinitely. If life begins at conception, which is what you're saying, then why do you support one but not the other?
Grant's response is enlightening because it really shows what abortion is about: controlling a woman's body. That's why he's not talking about embryonic stem cell research (stem cells taking from a blastocyst, no larger than the point of a pencil), but wants to talk about "what it takes to have a kid." Of course it's much easier to mislead people (it's a lie to say no positive research has resulted from embryonic stem cells) and distract them by talking about something unrelated to what this column is about.
But hey, why actually debate a topic when you can just hurl insults from your high horse?
