Judge Rules That Ultimate Warrior Cannot Recover Damages From WWE’s Self Destruction DVD
Posted by Larry Csonka on 09.18.2009
A bad day for Warrior…
- According to Pwinsider.com, the lawsuit that Warrior had filed against WWE back in January of 2006, in regards to the Self Destruction of The Ultimate Warrior DVD is over. Judge Douglas L. Rayes ruled that Warrior could not sue for damages over WWE's comments about him on the DVD. Warrior filed the claim stating that the DVD violated a March 2000 Settlement Agreement between WWE and Ultimate Creations Inc, which is Warrior's Arizona corporation. That agreement allowed WWE to use footage of Warrior, but that Warrior owned the rights and trademarks to the Ultimate Warrior character and could use them in any future venue as he decreed. It was also agreed that both parties would "not disparage each other". WWE agreed to pay $890,000 to Warrior's Ultimate Creations as part of the settlement agreement. The case had been dragging on, and during appearances, it was found that Warrior made "publicly disparaging claims" against WWE. It was ruled that Warrior himself breached the deal, and that he was not legally able to receive damages for the same thing he accused WWE of.
- Warrior made the following comments on his website about the case:
Hello, everyone. I wanted to get this news out before it got out other places and the idiotic pundits tried to claim I was hiding from mention of it because I am all consumed with grief, fear and embarrassment.
WWE won a round here in my ongoing litigation with them over the Self-Destruction DVD they produced. There were actually two lawsuits going on; one at the Federal level and one at the State level. The State Court has dismissed that case. They were similar in some ways, but much different in others. I'm not going to attempt to explain what a lawyer better understands.
I've attached the pdf file. I think it is public record, so I don't believe I'm violating anything.
It is what it is. There are no guarantees in litigation. None.
Of course, when you pursue these things, you want things to turn out in your favor. So does the other side. Cases are made and cards fall where they will.
What helps me handle it is that I am realist about things I cannot control and an optimist about all the incredible opportunity that always lies ahead, every day, every hour, every minute. I mean, from the moment you decide in your head that the past is done and gone, that it is a fact of reality you can't change, and you put your time and energy into moving forward, right then and there positive things begin to happen. Only when you change the world of your mind will things in world outside of you change.
There is no reason for hesitation except that you choose to stay stuck. The only force is your mind. I don't choose to remain stuck. I'm not good at whining and complaining about what I, myself, can, will and must do. I still have the rest of today to make the most out of myself and my life. I'm going to get at it.
Your Founding Father of Ring Intensity.
Always Believe,
Warrior

I think the Warrior is a dick, and even I'm rooting for him in this case. I think he's simply going to return to Parts Unknown and get ready for the next round.

"Judge Douglas L. Rayes ruled that Warrior could not sue for damages over WWE's comments about him on the DVD."
Then the Warrior, as tanned and rippling as the gods themselves, looked at his worn hands, lined with perspiration and the blood of the wicked, then to the heavens above, clouds parting out of fear as he did so, and wondered aloud just what level of DESTRUCITY~! was needed of him to defeat the charlatans, connivers, and, of course, homosexuals of the mortal realm.

Jim Hellwig clearly could not have written that statement. I can actually understand it.

Say what you will, but you have to admit that the world would be a much more boring place without the Warrior.

Somebody is siding with Warrior on this? I'm guessing you are someone that hates WWE just for the sake of hating WWE and have no actual knowledge of the history between Warrior and WWE.

I don't know what surprises me more: that the Warrior actually made a coherent blog post or that the WWE actually WON in court.
Posted By: Karatgold24 (Guest) on September 18, 2009 at 01:27 PM
Started out interesting, turned into a warrior promo about halfway through though... lol

Warrior made peace by Gorilla Pressing then Big Splashing his copy of the Self Destruction dvd.
I heard he's now working on a remake of Mr. Smith goes to Washington. His take on the fillibuster scene will be absolutely f'n epic.

I want to see Warrior play Mightor, in a live action film based on the old cartoon.

Well stranger things have happened. Especially where the Ultimate Warrior is concerned. And as far as disparaging comments, the truth hurts doesn't it Jim?
Posted By: mogamer (Guest) on September 18, 2009 at 02:08 PM
Seriously, that is the most sensible thing he's ever said and I wish more clients brought that kind of "you never know what can happen" mentality to a lawsuit.
Of course the client here brought unclean hands to the litigation, which is totally his fault and why it was dismissed, but still...it's refreshing.
As punishment for losing the suit for himself, the Undertaker should now lock him in an "air-tight" casket for 10 minutes again. (Anyone else remember that shit? I was freaked right the fuck out when that happened. I thought he died right on TV).

Meh this guy again?
Of all the 90's roid heads to NOT bend over and croak in a hotel room...... why won't he just go away? It's been freaking 17 years since you were a draw get over yourself, we all did.... then hit puberty and here we are 15 years later still w the same ol' Helwig.

I'm starting to think people hate on The Warrior because they're not smart enough to understand what he's saying. When people spread rumors about you that everyone believes don't you get mad? Now imagine it on a world wide level. He has every right to pursue justice especially when he thinks their settlement agreement makes this slander illegal.

Maybe after coming off steroids, Warrior can actually think clearly now.
Cool.
Say no to drugs,kids.

Usually I don't mind seeing WWE getting their asses handed to them in court but in this case I'll make an exception. Fuck Warrior.
Posted By: Zingy (Guest) on September 18, 2009 at 06:17 PM
Upon reviewing his earlier comments, Warrior added:
"I was in an adulated state of being when I fornicated my extrapolences on the cosmic chalkboard known to my Warriors as the Interwebnet. Have no inferiority: the Warrior still preaches the belief of Destrucity, and it will rain down on the bedazzlements of my inglorious opposition."

Since purchasing the rights of the Warrior name and trademarks what exactly has he done to use that name successfully in other avenues?
I thought the guy was awesome growing up and I still believe there is possibilities of his character and name being used successfully in other medias... I remember the god awful comics.. but I think Marvel should buy the rights and turn the Warrior into a Superhero of some kind.

I remember that. I was freaking out too. Didn't they have a guy with a drill trying to puncture air holes in the casket?

I'm not going to side with either of them.
Warrior is a nutcase who got too big for his britches and was a terrible worker. He was entertaining as hell, made them tons of money and basically was never satisfied or appreciative with what he was given.
WWE, on the other hand, as entertaining as the DVD is (I happily own it), it's a pretty jerky thing of them to do against one of their previous employees. Hell, they were going to do the same thing with Bret until he came forward and mended bridges with them.

I don't understand all of the Warrior hate. He is one of the best wrestling characters this side of the Iron Shiek! When ever there is a news story with his name in the headline you know that SOMETHING is going to be entertaining.

While THAAA WARRIAAAAAA comes across as both bitter and egotistical I think he is actually quite a smart guy with a lot of knowledge in both the political and legal systems ran in his country.
He may seem a bit mental but (with no sexuality phobia offence meant) Queering does not make the world work.
