UPDATED: Daffney Says She Has Filed A Workers Comp Claim Against TNA

UPDATED: According to Pwinsider.com, some TNA workers mentioned that there were issues between Daffney and the company over how her medical expenses. This was after she suffered a bad concussion taking a bump through a barbed wire board. The issue had reportedly been brewing for some time. When reached for comment, TNA's Steven Godfrey stated that the company does not comment publicly on personnel matters.

ORIGINAL: Daffney has posted the following regarding her status with TNA…

Yesterday my picture was taken down off of the TNA roster page. My contract expires today and TNA did not renew it. I do not know if it has anything to do with it, but I've filed a Workers Comp claim against them for injuries I've sustained in the ring and my lawyers said to not go into anymore details.

Even Kong didn't go ahead with suing TNA after incident last year. This is stupid. No offense to Daffney, but she became irrelevant when they debuted Winter who's doing her gimmick at the moment and is clean of injury.

TNA should probably be looked into for letting wrestlers with drug and alcohol problems work shows though.

She was told to wrestle that Team-3D rookie (Rosie) and got injured in that match. And now TNA refuses to pay her medical bills for a match she HAD to wrestle. So offcourse she is sueing them.

Her last match in TNA was three months ago (the December 9th Impact to be specific), and if I remember correctly, it was her first appearance in months. She rarely appeared after being injured by Rosie Lottalove in April 2010.

Sounds like her claim has more to do with how TNA responded to her injury, rather than the injury itself. The article doesn't say she's suing because she is too injured to ever wrestle again.

Doesn't TNA have insurance? Or is that ROH? If there was an agreement towards covering injuries, perhaps she needed medical treatment which TNA never paid for.

In short, wait for specifics, folks.

"Workers comp" and "independent contractor" status tend to not go together too well. Look it up. I don't know who is advising her, but she's getting some bad advice. He who writes the contract has the power. Sorry Daf, you're not an "employee" and not legally eligible for "workers compensation".

You're still entitled to Worker's Comp even if you're at-will. It's designed to protect you if you're hurt while in the course of employment. You're still an employee for those purposes. It's not so much that she's suing tna as much as she's making a comp claim.

follow up to my legal post...its all about legal terminology. Like I said, you can't get "workers comp" if you're not an "employee". Its just like how you can't file for "unemployment" if you were not an "employee". Its not about right and wrong, its about legal how terms which appear in contracts are defined in the established legal system. She'll be fighting the same sort of uphill LEGAL battle raven and sanders were fighting of trying to be classified as "employees" AFTER their contract term ended in wwe. You can't "win".

If she filed before the release which is how her statement reads then TNA is screwed and we do not know which injury this is over. I'm assuming the lot a love match where she was hurt bad. She didn't do much in the return tag match so she should nail TNA on this.

Nobody knows what provision for injuries are in TNA contracts. We do know they paid for Steiner, Douglas, Raven and Konan the man who sued them over racism. They have a history of paying so I can assume there is something to her claim.

They never paid Konnan's injuries. They paid him in a settlement because they were afraid to go to court. They knew they would loose that case.

WWE won't hire her cause the "goth" look is something McMahon doesn't find appealing in women. remember Ariel in WWECW? she had great presence, seemed to be over with the crowd, and was let go, one of the reasons being McMahon "not understanding" her i.e. she wasn't blond enough to make his dick wiggle. Daffney is pretty much in the same category; an unconventionally attractive weird girl that in another time would've been given a Sheri Martel sort of role but who doesn't fit into the current pro-wrestling climate's narrow view of what constitutes a marketable female. she's more Bizarre Magazine than Playboy and that's lost on most. our loss i guess.

For those of you questioning insurance for Wrestling promotions, it depends on the state the company is filled in. i.e. New York promotions have to carry insurance for the wrestlers. In New Jersey all you have to do is sign a waiver before entering the ring the waves all responsibilities of the promotion for injuries. So before all the computer chair lawyers go any further do some research on the athletic commission there and then respond.

Daffney is too old to be a WWE Diva and goth/vamp chicks don't fit the WWE mold; she'd have to get on Lita's type of rocker-chick gimmick and to get over she'd have to be at Lita's level (which, sorry Daffney marks, she is nowhere near). Add that to the fact that McCool would BURY her if she even made it past developmental and it all rings up to a loss. Time for the Scream Queen to retire.

Can't blame here, say what you want about WWE but when one of their guy's (or girls) gets injured in the ring they pay all their medical bills.

TNA has a history of not paying for injuries. Killings had to pay for his own knee surgery after getting hurt in a match for TNA, Konnan was told they'd help with his hip surgery and they didn't so he got a lawyer and an out of court settlement.
Now Daffney got injured working for them and they don't wanna pay her medical bills.
Not good business practice.

LOL at you silly wwe kiddies. Go back to watching your pg sesame street wrestling with John Cena. Daffney is well known, just not to the wwe cena worshipers. Apparently you people have lost most of your tiny brain cells. When we keep trying to tell you she was injured and if you work for a company and are injured then by law the company must pay for medical expenses.
