More Details On The Nick Hogan Trial & Sentence

As reported yesterday, Nick Hogan pleaded no contest Friday to the criminal charges stemming from his car wreck in August of 2007 that left his friend John Graziano permanently injured. He was sentenced to:

- Eight months in Pinellas County jail, starting immediately.

- Five years of probation which includes no alcohol.

- 500 hours of community service.

- Three years of having his driver's license revoked.

Other highlights from the trial included the following.

- The court did not give ajudication to the case. Had they done so, Nick would have been ruled guilty.

- The Judge called the case a "tragedy" for both the Hogan and Graziano families, noting that Nick and John's friendship turned into this.

- The Judge said that he did believe Nick has been hurt from the incident and is suffering emotionally.

- The Judge said that the accident wasn't really an accident since it could have been avoided at any time by making different decisions that day.

- The Judge said that he was impressed with some of the things he has seen and heard Nick and the Hogan family do for the Grazianos since the accident, but that he could not overlook the decisions Nick made.

- Nick had reached a deal ahead of time. In exchange for his no contest plea, he was promised a cap of one year prison time and five years probation. The Graziano family wanted "at least" one year of prison for Nick.

- Nick did address the court, saying he missed being around John everyday, saying he was like a brother and that he looked up to him. He apologized to the Graziano family and said he prays for John everyday.

- Nick said he has tried to become a better person since the wreck, noting that he has raised $60,000 for brain trauma research, and that some went directly to John's care.

- The Graziano family was very hard on Nick. John's father said that Nick had done in a few minutes what Al-Qaida couldn't do (a reference to John's time in Iraq). He said that John will need round the clock care forever and will probably never be able to communicate with his family again while Nick's life will go on. He even said that Nick did not have any remorse for the accident and seemed like he was being forced to visit John the times he did come and that he spent much of the time during those visits skateboarding in the hospital hallways. He also mentioned that Nick and the Hogans never showed up to John's boot camp graduation or his sendoff/return from military service, disputing Nick's claim that John was like a brother to him.

- John's sister also stated that Nick had not shown any remorse.

- John's girlfriend asked what kind of friend Nick was to bring skateboards and Nerf toys to John's hospital bed and play when he was suppose to be visiting John.

- John's mother said that the Hogans never apologized to her and that at the time of the accident, she was unaware that Nick had been arrested for speeding while having Hulk Hogan in the car with him and that Linda Hogan was videotaped bragging about racing. She also said some very emotional things about how excited she now gets when John moves his eyes towards her or is able to breath without a tube.

- Hulk Hogan spoke and talked about how he considered John a member of their family. He said that John spent days and sometimes weeks at their house when he was having issues with his father and that he even spent the night before he went to Iraq with the Hogans, not to mention going on vacations with them.

- Hogan said that his family has also been torn apart by this.

- Hogan said that Nick has gotten an unfair reputation because many judge him based on the persona he has on their VH1 reality show, but he said that show is scripted and that Nick was essentially acting in the show. He said that Nick is just a 17 year old boy and asked the Judge to not treat Hogan differently because he was from a celebrity family. He also said that the Hogan family will never give up on John and that he still prays for John's full recovery.

- Linda Hogan called the incident "heartbreaking" and that John was like a brother to Nick and Brooke. She cried at one point, saying Nick never wanted to hurt his friend and that he has to live with the pain of what he did forever.

- Brooke Hogan cried through her statement too, saying that John and Nick were best friends. She went as far as to insinuate that many in the court who were speaking on behalf of John had not been there for him in the past and were now after superficial things. She said that money is the root of evil and that it is why she hates being a celebrity.

Where did that come from? I know plenty of cases where poor people get drunk and crash there car, often hurting others.Dont see where money plays a part. Also, skateboarding in the hospital hallways? What a fucking dick. They should have sentenced him to 8 months living with Jake Roberts.

I believe she is implying the Grazianos are using John's health problems to get money out of the Hogans. That ties into her insinuation that they weren't there for John as well as Hulk's statement about John staying with the Hogans during problems with his father.

This is really an unfortunate thing. I feel for John's parents, but I find it odd that they never act like he was partially to blame for his own paralysis. If he would have worn his seatbelt, it seems he would have walked away, just like Nick did. But it seems they are only out for the money and playing it to the hilt. Glad to see Nick step up and take his punishment like a man. I have seen a lot of haters in other thread wanting to crucify him but I bet they would have handled it just as bad if not worse than Nick has. Hopefully he learns from this mistake and hopefully John's family can accept the consequences of their sons actions to 1.) not wear a seatbelt and 2.) his choice to get into a car of somebody that had been drinking.

And why the hell shouldn't they get at least a few million dollars out of the Hogan family? Can you imagine the medical bills that the Grazianos will be left with for the remainder of John's life? The Hogans, Nick specifically, should be responsible for every dollar.

First of all I wouldn't call her a 'celebrity' by any stretch of the imagination. Second her sincerity sounds about as legitimate as her singing talent. If she hates it so much why doesn't she stay out of sight? She doesn't need to work so she could easily stay hidden if she wants to. Even if she wanted to work she could easily be out of the public eye.

Nick will pay the price for arrogance and stupidity. Remorse now is irrelevant, since his past behavior demonstrates complete disregard for safety and the rules of the road. As for Graziano obviously you have to feel sorry for anyone, a soldier no less, who ends up being a vegetable like this. Very tragic, who knows what potential he had to do great things with his life. On the other hand that's what stupidity gets you. What do you think was the more likely scenario, that he cautioned Nick about the dangers or that he was on a mental high because of the speed? And let's not forget that there are multiple root causes of his condition. Speed was one, but his utter lack of sense in not wearing a seatbelt was the other.

The parents are responsible too. This is what happens when you allow a sense of ultra-privilege and a mindset of being above the laws of both society and physics to take root.

Al-Qaeda...The father is ignorant. If your son is going to war, at least know the facts. Al-Qaeda was based in Afghanistan. Most non-Americans fighting in Iraq are Iraqis defending their own landspace from Americans and other tribes.

It was a drunk driving accident. this is probably one of the most common law cases for young men in this country.

Nick was wrong and wreckless, but I have a feeling thousands of other young men have this same situation right now and nobody knows because it doesn't make it past local news!

This isn't about Brooke; her comments are negligable. It's silly that most comments I've seen have been about her.

Nick is most at fault for getting behind the wheel and racing while drunk, and Nick is paying for his decisions both in the figurative and literal sense. Hulk Hogan is at least partially at fault for buying the alcohol for them, as is John for not buckling up. Nick's sentance was fair, I think, and he should continue to fund John's bills of his own volition.

John's family, understandibly, was looking for vengance. They got justice. What's done is done, and now Nick has eight months to grow up. If he doesn't come out of prison with a matured perspective, he's an idiot and a waste.

Sounds to me the Graziano is trying to capitalize on a son they never really cared about or had issues with !!!!

It is tragic but John is older than Nick and both were drinking !! And later that day it was already stated John was doing burn outs in the car !!

The Graziano seem very vindicitve

John didn't wear a fucking seatbelt and WILLINGLY got into the car with his drunken idiot friend who decided to race.

They're both idiots, and while it's unfortunate that this tragedy happened, the Graziano's being so wrathful to the Hogan family is a crock of shit. And I hate Hogan. Sounds like a money-grabbing scheme, even though John was equally in the wrong as Nick.

It's a damn shame when stupid shit like this happens.

WTF - If you were in John's condition I'd hope to hell your family wanted a drunk driver to be jailed for over a year, because the kid is an immature douchebag who shouldn't be walking out of jail in 8 months. He should be walking out of jail in ten years, life if the kid dies. This celebrity treatment is crap and he deserves a lot worse for what he did. Skateboarding in a hospital is not showing remorse. Playing and acting like you don't want to be there isn't remorse. What a joke the American judicial system is when it comes to celebrities.

I have to wonder why the graiziano family chose to keep him on life support if he is as messed up as we are being led to believe? I know my family knows not to keep me around like this if it where ever to happen to me. Obviously everyone involved in this incident is @ fault in some way shape or form, and the sentence that he received is actual pretty pretty harsh considering no one was actually killed. You do have to feel sorry for someone who served in Iraq and has come home to this though.

i do think the sentence he recieved was quite unfair and he should have got more jail time. what were forgetin is this could have happened to anyone..... come on how many of you guys have thrashed your cars and just been lucky? he was just a silly boy with a fast car and to be fair his friend shud have been wearin a seatbelt. dont belive everything you read or hear.. how do you know that nick hogan was riding a skateboard in the hospital hallways? remember, the parents of john probably hate nick and would say anything to change youre thoughts on him. im not saying its right what he done and he should be let off but put yourself in nicks shoes... hes shamed his family name and nearly killed one of his friends. how would you feel? it wont surprise me if he ends up on suicide watch? my heart goes out to both the familys!

and yeah i know im gonna recieve some nasty feedback from some of you guys but its just my opininion
